Our website and its subdomains, along with the Pawska apps, are collectively referred to as the “Site.” By visiting our Site, you are agreeing to these terms and conditions.

We strive to keep our policies straightforward, but there are certain rules that must be followed. Please read these terms and conditions carefully. If you have any questions or do not understand something, please contact us, and we will do our best to assist you.

IMPORTANT: WE RESERVE THE RIGHT TO CANCEL YOUR MEMBERSHIP AT ANY TIME FOR ANY REASON. THESE TERMS AND CONDITIONS EXPLAIN THAT RIGHT.

Please note that we may update these terms and conditions from time to time. It is your responsibility to review this page regularly for any changes, as we will assume you have done so each time you use the Site.

Agreement

This page forms the basis of the relationship and agreement between you and us. By using the Site, you agree to be bound by these terms and conditions.

Your Promises To Us

By using the Site, you warrant and agree that:

  • You have the right to enter into this agreement and are over the age of 18.
  • You will have only one account with us.
  • All information provided by you when creating an account is true, accurate, and complete. You are not creating the account on behalf of anyone else.
  • If you choose a username or breeder name, it will not be offensive, misleading, or suggest that you represent a trade or brand name if you are a private advertiser. If you are a breeder or company, you must not suggest that you are a private advertiser. We reserve the right to require you to change your username if it violates this term.
  • You will read and comply with the terms and conditions of any websites you visit through links on our Site.
  • You will not use robots, spiders, scrapers, or similar tools on our Site.
  • You will not attempt to bypass any measures we put in place to restrict or control access to parts of the Site.
  • You will not engage in any activity that could cause our Site or system to crash.
  • You will not steal, copy, or otherwise use the Site or any part of it for any other site or application.
  • You will not attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any programs we use in connection with this Site, its system, or the services it offers.
  • You will not copy, imitate, or use our trademarks, designs, layout, or any other intellectual property without permission.

Intellectual Property

You do not have the right to copy or use any information or intellectual property on the Site, except as necessary for your use of the Site. All information and intellectual property on the Site are owned by us or our affiliates.

We cannot verify the ownership of content uploaded by users and make no warranties regarding the rights of those who post content. If you believe your intellectual property rights have been infringed, please contact us, and we will remove any material that breaches those rights.

By uploading images or videos to the Site, you grant Pawska and its licensees a royalty-free, non-exclusive, worldwide right to use, reproduce, edit, publish, display, distribute, and otherwise use the content in all media, now known or hereafter devised, in perpetuity. This includes use in promotional materials for Pawska, both online and in print.

We will have no rights in any content you store in our system other than those contained in these terms and conditions. You will indemnify us against any liabilities arising from your posting of material to the Site.

Your Use of the Site

You acknowledge that the primary purpose of the Site is to facilitate the re-homing of animals and the sale of related accessories and services within the UK. The Site is not intended to support your business or personal financial gain.

If you are advertising pets on the Site, you agree that you have discussed your licensing requirements with your local council’s animal licensing team and have obtained any necessary animal activities licence. This information must be entered in your account details, and a copy of your valid licence must be uploaded.

Company Account

By creating a company account on Pawska, you warrant and agree:

  • You are legally capable of entering into binding contracts on behalf of the company you represent.
  • You will not attempt to rehome any animals, whether as a seller or a buyer.

General Ad Posting Rules

When posting an advert on Pawska, you warrant and agree to comply with the following conditions:

  • Any pet(s) advertised must be owned by you unless specified that they are being sold on behalf of a charity organisation. If advertising a litter of kittens or puppies, they must be owned or bred by you.
  • To meet PAAG’s minimum standards, we reserve the right to refuse any advert(s) that may compromise them.
  • We enforce age restrictions for rehoming or collecting pets in line with animal welfare guidance: dogs, cats, rabbits, and ferrets cannot be separated from their mothers before 8 weeks of age; chinchillas at 12 weeks; and foals must be at least 6 months old before leaving their mothers.
  • When advertising a litter, the litter must be advertised together, and a photo of the litter with their mother must be uploaded. This applies to dogs, cats, rabbits, ferrets, and chinchillas.
  • Adverts must be posted in the correct category, and the pet’s full breed must be disclosed for transparency. If the pet is a crossbreed, this must be explicitly stated in the description and advertised in the mixed breed category.
  • Photos of pets must be of the actual pet you wish to rehome and not copied from the internet.
  • Adverts must not promote or infer that pets are gifts or presents for special holidays like Christmas, Easter, or Valentine’s Day.
  • Pets advertised must be located in the UK, and the location stated on your listing must be where the animal is currently and permanently housed.
  • Pets imported into the UK for the purpose of sale cannot be advertised. Pets imported into the UK and under 6 months old cannot be sold. However, older pets legally imported as your own pets can be rehomed, with the country of origin stated in the advert description.
  • Pregnant pets or pets suspected of being pregnant cannot be advertised. This includes horses.
  • Advertisements that seek to swap or exchange any pet are not permitted.
  • Selective breeding or advertising aimed at promoting extreme conformations or features in pets is not allowed.
  • You must clearly identify all health and welfare issues associated with any pet you wish to rehome.
  • Adverts offering delivery or courier services for pets are not permitted. A pet in a litter must be collected from the house where the mother of the litter lives.
  • Pets for rehoming must be available for viewing at your home or place of business.
  • Large commercial breeding of pets is not allowed, regardless of licensing status.
  • Individuals under 18 cannot advertise a pet for sale, adoption, or stud on the website. Additionally, individuals under 18 cannot use the website to contact an advertiser. If advertising a pet, you must ensure anyone adopting or buying your pet is at least 18 years old.
  • We reserve the right to decline any adverts, ban, close, or suspend a user’s account if we suspect inappropriate behaviour or unethical breeding, which is not limited to the rules above.

If you break any of the above rules, we may end all or any adverts you have placed with us and close your account.

Dog/Cat Specific Ad Posting Rules

In addition to the general ad posting rules, you warrant and agree to comply with the following conditions when posting any puppy/dog or kitten/cat advert on Pawska:

  • Dogs must be microchipped from 8 weeks of age and older.
  • All pets advertised must be in the UK. Rescue pets from abroad may be advertised by registered charity accounts if the pets are currently in the UK, have all required documentation, and are vaccinated/microchipped according to UK standards and law.
  • If selling a litter, you must show all puppies and kittens to any prospective owner with their mother and, if possible, their father.
  • Litters must be advertised together under one advert.
  • Adverts for bred-in aesthetic pets will be removed. Descriptions including words such as ‘Micro’, ‘Big-Rope’, ‘Teacup’, ‘Miniature’ (unless referring to a miniature pedigree breed), ‘Designer’, or similar expressions are not permitted.
  • Banned breeds cannot be advertised. This includes Pit Bull Terrier, Japanese Tosa, Dogo Argentino, Fila Brasiliero, and from 30 December 2023, XL Bully listings.
  • Only family pets may be advertised. Guard dogs or dogs trained for security, protection, hunting, or guarding cannot be advertised.
  • Dogs with cropped ears cannot be advertised.
  • Ads for artificial insemination or spay/neuter procedures are not allowed.
  • Co-ownership, rent, or loan agreements for dogs or cats, except in the stud category, are not permitted.
  • Pets cannot be advertised for sale for the purpose of breeding. For example, a stud dog or a dog in season cannot be advertised for sale.
  • Dogs and cats cannot be advertised for stud/mating if they are under 12 months of age.
  • Advertisements containing double dapple or double merle dogs are not permitted.
  • If a pet is registered with a governing body, such as the Kennel Club for dogs or GCCF for cats, this must be stated in the advertisement, and all paperwork to verify that registration must be provided if required.
  • In Scotland, any user breeding three or more litters of kittens in any 12-month period must hold a valid cat breeder’s licence under Scottish government guidelines.

Other Animals Ad Posting Rules

In addition to the general ad posting rules, you warrant and agree to comply with the following conditions when posting any animal other than dogs or cats on Pawska:

  • You will not offer live vertebrates for rehoming intending them to be used as food.
  • If advertising an animal listed under Annex A of the CITES regulations for endangered species (such as some tortoises, snakes, and birds), you must state in the advert that you have a valid Article 10 certificate.
  • Adverts for any types of primates are not accepted.
  • Adverts for any wild-caught animals or any animals that come under the Dangerous Wild Animals Act are not accepted.
  • Anacondas, Burmese Pythons, Reticulated Pythons, African Rock Pythons, Spider Morphs, or Enigma Morphs cannot be advertised.
  • All horses advertised must be microchipped and have a passport as required by UK law.
  • In photographs advertising horses, the rider must wear a riding hat and appropriate footwear.

Breeding and Licences

If you are a breeder and advertising dogs for sale and require a dog breeding licence from your local council, you need to be registered as a licensed breeder on the site and provide us with a copy of your licence. You will also be required to upload your licence number and local authority name to your account with us. If we suspect you need to be licensed and have not provided your licence details, we reserve the right to decline your adverts, and we may report this to your local authority.

If two different litters are posted or born in the same 30-day period, we require that a breeding licence is uploaded to your account.

Pet shop licence holders are only permitted to advertise puppies or kittens for sale if they hold a valid breeding licence and have bred the pets themselves in the UK.

Accounts

To benefit fully from the Site, you must create an Account containing certain personal details. By creating an Account, you promise that:

  • All information you submit is complete, accurate, and truthful.
  • You will keep this information accurate and up-to-date.
  • You must clearly state whether you are using our services as a private individual, frequent advertiser/breeder, rescue centre, or company.
  • You must enter your correct full address before placing an advert. This must include your house number, street address, and postcode. We may ask you to verify your home address if needed. However, we will not publish your full address on the website.
  • You will use only one account to advertise any pets you own or breed. For example, you will not create and use multiple accounts under different names and addresses to hide the actual number of pets you breed or advertise.
  • If we receive complaints regarding your account, you must resolve any issues to both the customer’s and our satisfaction.
  • You will not share your Account with anyone or advertise pets on your account on behalf of other people.
  • You will keep your Account details confidential and secure.
  • You will not give your password and login details to anyone else.
  • You will log off when you exit the Account to prevent unauthorised use by others.

Your Account will be closed by us if you break these T&Cs.

Your Account may be closed by us at any time if we give you notice to that effect by email, to the last email address you used on your account or the one you last used to communicate with us.

If your Account is closed for any reason, you will not be entitled to any form of compensation for any loss you might suffer, even if you have paid for certain products on our website.

If you do anything we think might be fraudulent or otherwise criminal in nature, we have the right to report those actions to the Police and keep any money standing to the credit of your Account to cover the costs incurred dealing with your fraud.

If we ask you to, you must authenticate your email address and personal details with us. If you change your address at any other time, you must tell us and authenticate it again.

If you have not authenticated your current email address with us and/or if it cannot accept emails from us and/or you mark our emails as spam, abusive, or junk, we may terminate your Account without notice.

If we earn any commission on any transaction in which we are involved or any interest on the money deposited in your Account, we may keep that commission and/or interest.

Contacting An Advertiser

You acknowledge and agree that we cannot check the truth or accuracy of any statement made by any person advertising on Pawska.

You accept that you have the responsibility to verify all statements made and all documentation offered by any advertiser.

You confirm that you have read the Buying Check List posted on the Site and on every pet advert, particularly the advice we give never to send any money online to an advertiser for a pet or a deposit for a pet unless using the Pawska Safe Deposit Scheme. You acknowledge that we do not have any means of verifying the honesty of any advertiser and that if you send money using another online service, we have no responsibility to you if, and when, you lose that money.

You should confirm that the advertiser is a genuine person. You can do this by visiting the pet at the advertiser’s home. If they make excuses or try to ask for money or a deposit without seeing the pet, or if the advertiser attempts to deliver the pet or meet you at any location other than their home, do not agree to this.

You should always use our secure in-platform messenger system and not accept any invitation to use any alternative messenger system, such as WhatsApp or email. Our system is secure and allows you to share images. You also warrant not to use offensive wording, spam users, or use our messenger system in any automated or commercial way. We reserve the right to filter or block messages that we deem suspicious before they reach the counter-party. We also reserve the right to block users based on misuse of our messenger system.

Using Payment Services

Pawska charges fees for certain services, such as uploading adverts, promoting your advert, or processing payments to other users. Our prices are quoted in Pounds Sterling and are subject to change. Promotional events or new services may have different fees, which become effective upon announcement.

You are responsible for paying Pawska’s fees when due. Failure to do so may result in limitations on your ability to use our services.

Paying for Uploading Adverts or Promoting Adverts

Payments for uploading or promoting adverts are processed through the electronic payment system Stripe. The trading entity is HästNet Sverige AB, the parent company of Pet Media Ltd, which owns the trademark Pawska. We only store the necessary information required to make a purchase. Your credit card information is not stored by us and is always processed securely via Stripe.

By agreeing to these terms and conditions, you also agree to Stripe’s Privacy Policy regarding the processing of data for payments on the site. Visit Stripe’s website for more information.

We are not liable for the acts or omissions of third-party payment service providers. You are solely responsible for the transmission of your credit or debit card information, and we exclude all liability to the extent permitted by law.

Payments made for our services are non-refundable if your account is terminated due to a breach of these Terms.

Using Pawska’s Pet Payment Service

For payments through Pawska, we apply Anti-Money Laundering (AML) and Know-Your-Customer (KYC) rules through Stripe. By using this service, you agree to Stripe’s Terms of Service and Privacy Policy regarding data processing. Visit Stripe’s website for more information.

If you are a UK resident or registered business, Stripe Payments UK Limited is a company registered in England & Wales (company number 08480771), with its registered office at 9th Floor, 107 Cheapside, London, EC2V 6DN. The UK Financial Conduct Authority has authorised Stripe Payments UK Limited as an electronic money institution (reference number 900461).

Pawska reserves the right to withhold refunds for buyers or sellers in case of a breach of our terms.

Advertising Rules

All adverts posted under Pawska Unlimited must adhere to the Ad Posting Rules outlined in this document.

Pawska Unlimited

Your Pawska Unlimited subscription will continue until you cancel it. You must provide a valid Payment Method to use Pawska Unlimited. ‘Payment Method’ means a valid, accepted, and current method of payment, including payment via a third party. You may update your payment method as needed. Unless you cancel your subscription before the renewal date, you authorise us to charge the membership fee for the next year to your Payment Method.

We may occasionally offer promotional membership plans. Eligibility for promotional offers is determined solely by Pawska, and we reserve the right to revoke any offer.

For certain breeds or categories, Pawska may enforce the mandatory use of the Pet Payment service for animal welfare or safety reasons. If a seller repeatedly encourages buyers to pay outside the platform, we reserve the right to block the seller’s account.

Limitation of Liability

We have limited resources and cannot guarantee a specific timeframe or response to any message you send to us, though we strive to respond within 24 hours. Therefore, we hold no liability if we cannot meet this timeframe.

As a platform for displaying pets for rehoming, accessories, and services, we do not vet advertisers or control any transactions. You enter into any transaction with other users at your own risk.

We do not accept liability if you use our services for commercial purposes.

Neither we nor anyone working with or for us are liable for any losses incurred from using our services, visiting the Site, or using the System.

We bear no liability for the ending of any advertisement you place on the Site, whether terminated by you or us.

If found liable for any loss, our liability is limited to direct losses up to £100. This excludes indirect, special, or consequential losses, and does not affect liability for death or personal injury resulting from negligence or fraud.

Links to Other Websites

We do not control the content of websites we link to and disclaim liability for any losses resulting from their use.

Our linking to a site does not constitute endorsement or recommendation.

We cannot guarantee that all links will work.

If you find any linked content offensive, please inform us.

If you link to another site using our Site, you agree to the separate conditions of those sites.

Modifications of These Terms and Conditions & the Site

These T&Cs may change, and you must check for updates each time you access the Site.

We reserve the right to change the Site, but these T&Cs will still apply.

General Stuff

  • Operative Law: This Agreement is governed by the laws of England and Wales.
  • Partnership/Joint Ventures: This Agreement does not form the basis of any partnership or joint venture.
  • Effect of Agreement: This Agreement supersedes any previous agreements and represents the entire understanding between the parties.
  • Time of the Essence: Time is not of the essence in this Agreement.
  • Warranties: All parties acknowledge they have not entered into this agreement based on anything not included in these T&Cs.
  • Force Majeure: We are not liable for events beyond our control.
  • Unenforceability: If part of these T&Cs is unenforceable, the rest remain valid.
  • Notices: Formal notices must be sent via email.
  • Entire Agreement: These T&Cs contain the entire understanding between us.

Definitions

  • Account: Personal information used to access the Site.
  • Advert: Any advertisement placed on the Site.
  • Breeder: Individual breeding within legal limitations.
  • Content: Information on or part of the Site.
  • Licensed: Breeder with required licensing.
  • Pet: Tamed or domesticated animal for companionship.
  • Refund: Return of services for monetary value.
  • System: Storage system used with the Site.
  • T&Cs: Terms and conditions.
  • User: Anyone using the Site.

Pawska Unlimited Cancellation

Renewal Date

Pawska Unlimited subscriptions last for one year, starting from the date of your first payment. They automatically renew one year later unless cancelled. The membership fee will be charged to your Payment Method on your renewal date, which you can find in your confirmation email.

Payment Methods

You must provide a Payment Method to use Pawska Unlimited. By signing up, you authorise us to charge the Payment Method you initially used for future renewals, unless you specify a different Payment Method or cancel your subscription. If a payment fails, such as due to insufficient funds or card expiration, and you do not cancel your membership, we reserve the right to suspend your subscription until a successful payment is made.

Updating Your Payment Method

You can update your Payment Method by contacting support@pawska.co.uk.

Cancellation

You can cancel Pawska Unlimited at any time and continue to enjoy free advert listing fees until your next renewal date. To cancel, contact support@pawska.co.uk. If you cancel, you will lose access to the benefits of your subscription on the next renewal date and will not be charged for a new subscription. Payments are non-refundable, and we do not issue partial refunds or credits for cancellations during the subscription period.

Changes to Pawska Unlimited Prices

The price of Pawska Unlimited may change. Any changes to your subscription or its price will apply no earlier than 30 days following notice via email. You can cancel your subscription if you do not wish to accept the new price or any changes, but this must be done before your next renewal date.

Pawska Unlimited Ad Posting Rules

As a valued member of the Pawska Unlimited community, you can post advertisements for pet litters or individual pets at no extra cost. To maintain the integrity of our marketplace, the following guidelines apply:

  • Single Advertisement per Litter/Pet: Members may post one unique advert for each litter or individual pet. This prevents oversaturation and maintains a fair environment.
  • Advertisement Duration and Reposting: Each advert remains live for 60 days. After expiration, you may create a new listing with updated information.

Compliance with these policies is mandatory. Breaching this policy, such as posting duplicate adverts, may result in the revocation of your Pawska Unlimited status and/or account suspension.

Cancellation By Us

We reserve the right to cancel any advert you place or your account:

  • With immediate effect and without notice if we suspect you have breached these terms and conditions.
  • With immediate effect if we notify you via email.

You agree that you are not entitled to compensation if we cancel an advert or your account, with or without reason.

Cancellation By You

For the purposes of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, no “sale” is involved in our services, and you have no right to cancel this Agreement.

Disclaimers

We cannot guarantee that the Site will meet your needs, work properly, be fit for a particular purpose, or be free from infringement. We cannot promise that the Site will work with all systems, be secure, or that all information provided will be accurate.

Any advice given on the Site is general in nature and may not apply to your circumstances. You must verify that the advice is effective for you unless given as part of a paid service.

We take reasonable efforts to test material before placing it on the Site. However, we are not responsible for any loss, disruption, or damage to your data or computer system caused by material on the Site.

We cannot guarantee any specific outcomes based on suggestions in our materials. These are provided as general suggestions, not as warranties of specific results.

The only rights you have under these T&Cs are those mentioned within them. If a right is not mentioned, it does not exist unless provided by law.

Problems and Complaints

If you experience any problems, you must inform us immediately. We will attempt to resolve the issue as quickly as possible, at no charge, if we agree there is a problem.

To raise a complaint, send full details via our Contact Page. If we agree your complaint has merit, we may contact any other user involved, suspend an advert, or take other steps as appropriate. We do not have a formal complaints procedure but will handle complaints in the most reasonable way forward. Nothing in these T&Cs affects your legal rights.

Availability of the Site

We do not guarantee that the Site or System will always be available. You cannot hold us responsible for any loss resulting from unavailability.

We reserve the right to change the Site and its services, the way it operates, or suspend/stop it at any time.
